Somewhere Inn Terms of Service

These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly and made available online, through any mobile device, by email, or by telephone. By accessing, browsing, and using our (mobile) website or any of our applications through whatever platform and/or by completing a reservation, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below (including the privacy statement).These pages, the content, and infrastructure of these pages and the online reservation service (including the facilitation of payment service) provided by us on these pages and through the website are owned, operated, and provided by Somewhere Inn and are subject to the terms and conditions set out below.

Bookings

All bookings at Somewhere Inn are subject to these terms.

We shall also have the right to require full payment in advance or a deposit at the time of booking in certain circumstances or if the booking includes the supply of certain items or services. No booking shall be treated as confirmed until the details and/or payment/deposit described in this paragraph have been provided.

Charges

The prices displayed on the websites are an average per night per person until a rate is selected. Any meals, service or HST (at the prevailing rate) are included only if specified. A minimum length of stay, deposit, cancellation charge and other conditions may apply to certain rates, as specified. Once a rate is selected on the websites, the total for your requested stay shall be displayed on the reservation summary. Prices shall be charged in the local currency of Somewhere Inn and any currency conversion facility, if provided, is an approximation tool only.

The HST breakdown shown is indicative based on the current rate of HST, and the expected HST treatment of the goods or services. HST will be payable at the prevailing rate applicable at the tax point of the invoice or booking confirmation issued and may change depending on the actual rate and the HST treatment of the goods and services purchased at that date.

Price lists, if any, for additional items, such as privately arranged meals and specialty booking or tour services, are available on request.

Limited Hours

Somewhere Inn typically operates the front desk for 12 hours per day from 9am to 9pm on weekends year-round and summer weekdays. Opening hours for the lobby are reduced from time to time depending on the time of year, occupancy of the hotel, and weather.  We reserve the right to close any facilities due to weather conditions, staffing requirements, or for Health and Safety reasons without prior notice. Availability of all amenities are dependent on a seasonal schedule and weather.
 

Check-in/ Check-out Requirements

In the interests of security and to prevent fraud, at the time of check-in, guests may be required to confirm their identity by providing their booking reference; their passport/identity card/drivers license and a valid credit or debit card. The information above may be requested for each member of your party over the age of 16 and we reserve the right to refuse entry to persons who cannot provide the information set out above.

Unless otherwise stated on the booking confirmation, guests may check-in at any time from 3:00 p.m. on the scheduled day of arrival. All rooms that have been secured by credit/debit card or prepaid at the time of booking will he held until 11:59pm on the scheduled day of arrival unless otherwise agreed directly with Somewhere Inn.

On the day of departure, we kindly ask all guests to vacate their rooms by 11:00 am (unless a later departure is stated as part of your booking). Late check-out after this time can be requested subject to availability and will be charged at an hourly rate at the discretion of Somewhere Inn. Rooms are subject to maximum occupancy rules set by Somewhere Inn. If you would like further details, please contact Somewhere Inn.

Payment

We accept the following methods of payment: credit cards: American Express, MasterCard, Visa.

For advance purchase rates the card you booked with may be required to be presented on arrival, along with an appropriate ID.

At the time of reservation we will authorize the accommodation charges (room rate, HST and any service charge) for the duration of your stay against your credit/debit card and charge your credit/debit card six days prior to your arrival for the accommodation charges for the duration of your stay. We may also choose to accept a deposit in place of payment card authorization by another valid form of payment, including cash or check.

Changes or Cancellation by Somewhere Inn

Very occasionally we may need to cancel your booking. In such circumstances you will be given a full refund, but we shall have no further liability to you arising out of such cancellation.

If your booking is for a specific room and in the same room for the duration of your stay through a “choose your own room” on the website, we will use our reasonable efforts to honor your room selection. However, we may need to allocate an alternative room to you for operational or safety reasons. If we need to move you to a different room during your booking for which a lower rate is available than the rate you booked at, we will refund you the difference in the rates.

Damage

We reserve the right and you hereby authorize us to charge your credit or debit card for any damage incurred to your room or Somewhere Inn during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave.

Parking

Somewhere Inn has on site designated parking.

Cars and their contents are left at the owner’s/Guest’s own risk. We do not accept responsibility for loss or damage however caused (save as may not be excluded or restricted by applicable law).

Guest Behavior

Guests are requested to conduct themselves appropriately at all times and to comply with Somewhere Inn procedures and/or requests with regard to conduct and respect for the property of Somewhere Inn, its employees and guests and their health and safety. Guests are requested not to disrupt the comfort and enjoyment of other guests, the operating of Somewhere Inn, or cause offense to other guests or our members of staff. We reserve the right to refuse accommodation or services or remove you and members of your party from Somewhere Inn if, in our reasonable opinion, we consider this provision to have been breached. Where this is the case Somewhere Inn shall have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred.

No Smoking

Guests are not permitted to smoke, including vaping or any other substance, in rooms or anywhere on the premises. Somewhere Inn reserves the right to charge a $500 cleaning fee if it is determined that there has been smoking in the room.

Children

All children (a person under 18 years of age) must be accompanied by an adult and must be supervised by an adult at all times.

Pets, Emotional Support & Service Animals

Somewhere Inn welcomes well-behaved dogs in rooms and on the grounds for an additional nightly fee. Service animals are welcome in all parts of our facilities that are open to the public. Service animal documentation is required for service animals. No additional deposit for a service animal is required.

No Discrimination

It is the policy of Somewhere Inn not to discriminate on the grounds of sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, or sexual orientation. We believe that we have a duty to our guests to protect them from inappropriate behaviour. Guests are expected to adhere to this policy and Somewhere Inn may, without incurring any liability to the Guest, immediately remove from the property any person(s) offending against this policy. Should any actions by a Guest be deemed inappropriate by Somewhere Inn, or if any inappropriate behaviour is brought to the attention of Somewhere Inn, we reserve the right, after any allegations have been investigated, to take action against the Guest.

Force Majeure

Somewhere Inn accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.

Limitation of Liability

Somewhere Inn will not be responsible for the loss or damage of any property left at Somewhere Inn.

Somewhere Inn will not be liable for any indirect, consequential or pure economic loss or any loss of profit, goodwill or opportunity (whether caused by the negligence of Somewhere Inn, its employees, contractor or agents or otherwise). Somewhere Inn’s total liability shall not exceed the value of the charges received by it under the Agreement.

Nothing contained in the Agreement or in any other document referred to or incorporated in it shall be read or construed as excluding any liability for death or personal injury caused by Somewhere Inn negligence or liability for fraud or fraudulent misrepresentation.

Governing Law and Jurisdiction

This Agreement and any non-contractual obligations arising in connection with it are governed by the province of Ontario and have exclusive jurisdiction to determine any dispute arising in connection with the Agreement, including disputes relating to any non-contractual obligations.

Each party irrevocably waives any objection which it may now or later have to proceedings being brought in the Ontario courts (on the grounds that the Ontario courts are not a convenient forum or otherwise).

Web Site Information

While all reasonable efforts have been taken to ensure the accuracy of information on the websites, Somewhere Inn does not accept responsibility for errors or omissions and reserve the right to amend, cancel or vary any of the arrangements featured on the websites without notice. Please note that in certain circumstances, generic photographic images have been used to represent the general style of a particular product or Somewhere Inn.

The content of the websites is the copyright of Somewhere Inn, and may not be copied, reproduced, published, distributed or amended for any other purpose without our prior written consent.

Trademarks used on the websites are the property of the respective owners. Hyperlinks to third party websites are provided for your convenience. We cannot accept responsibility for the content or use of third-party sites.

Somewhere Inn Privacy Policy

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.somewhereinn.ca (the “Site”).

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Order Information.

HOW WE USE YOUR PERSONAL INFORMATION

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
Communicate with you;
Screen our orders for potential risk or fraud; and
When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use Cloudbeds to power our booking site and Shopify to power our shop and checkout. Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

BEHAVIOURAL ADVERTISING

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

Somewhere Inn SMS Messaging Terms & Conditions

This SMS message program is a service of Somewhere Inn. By providing your cell phone number, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., SMS/MMS cart reminders, sale notices, etc) from Somewhere Inn. These messages include text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. You give Somewhere Inn permission to send text messages to the enrolled cell phone number through your wireless phone carrier, unless and until you end permission per these Terms & Conditions. Consent to receive automated marketing text messages is not a condition of any purchase. Message & data rates may apply.

Message frequency may vary. Somewhere Inn reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. Somewhere Inn also reserves the right to change the short code or phone number from which messages are sent and we will notify you if we do so.

Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. Somewhere Inn, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

By enrolling in the Somewhere Inn messaging program, you also agree to these messaging terms & conditions (“Messaging Terms”), our Somewhere Inn Terms of Service and Somewhere Inn Privacy Policy.

Cancellation

Text the keyword STOP, STOPALL, END, CANCEL, UNSUBSCRIBE or QUIT to the telephone number, long code, or short code that sends you our initial confirmation message to cancel. After texting STOP, STOPALL, END, CANCEL, UNSUBSCRIBE or QUIT to the telephone number, long code, or short code that sends you our initial confirmation message you will receive one additional message confirming that your request has been processed. If you change your preferences, it may take up to 48 hours for it to take effect. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP, STOPALL, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands and agree that Somewhere Inn and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from Somewhere Inn through any other programs you have joined until you separately unsubscribe from those programs.

Help or Support

Text the keyword HELP to the telephone number, long code, or short code that sends you our initial confirmation message to receive a text with information on how to unsubscribe.

No Warranty

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT THE MESSAGING PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Limitation of Liability

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, YOU AGREE THAT IN NO EVENT SHALL EITHER OF Somewhere Inn OR ANY PARTY ACTING ON BEHALF OF Somewhere Inn BE LIABLE FOR: (A) ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN AN AGGREGATE AMOUNT EXCEEDING THE GREATER OF THE AMOUNT YOU PAID TO Somewhere Inn HEREUNDER OR $100.00; OR (B) ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR ANY OTHER DAMAGES. YOU AGREE EVEN IF Somewhere Inn HAS BEEN TOLD OF POSSIBLE DAMAGE OR LOSS ARISING OR RESULTING FROM OR IN ANY WAY RELATING TO YOUR USE OF THE Somewhere Inn MESSAGING PROGRAM. Somewhere Inn AND ITS REPRESENTATIVES ARE NOT LIABLE FOR THE ACTS OR OMISSIONS OF THIRD PARTIES, INCLUDING BUT NOT LIMITED TO DELAYS OR NON-DELIVERY IN THE TRANSMISSION OF MESSAGES.

Indemnity

To the maximum extent allowed by applicable law, you agree to indemnify, defend and hold harmless Somewhere Inn, its directors, officers, employees, servants, agents, representatives, independent contractors and affiliates from and against any and all claims, damages, liabilities, actions, causes of action, costs, expenses, including reasonable attorneys’ fees, judgments or penalties of any kind or nature arising from or in relation to the these Messaging Terms or your receipt of text messages from Somewhere Inn or its service providers.

Dispute Resolution

General. Any dispute or claim arising out of or in any way related to these Messaging Terms or your receipt of text messages from Somewhere Inn or its service providers whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a dispute or claim arises will be resolved by binding arbitration. YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE MESSAGING TERMS, YOU AND Somewhere Inn ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT THESE MESSAGING TERMS SHALL BE SUBJECT TO AND GOVERNED BY ARBITRATION.

Exceptions. Notwithstanding subsection (a) above, nothing in these Messaging Terms will be deemed to waive, preclude, or otherwise limit the right of you or Somewhere Inn to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in aid of arbitration from a court of competent jurisdiction; or (iv) file suit in a court of law to address an intellectual property infringement claim.

No Class Actions. YOU AND Somewhere Inn AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Somewhere Inn agree otherwise in a signed writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. You agree that, by agreeing to these Messaging Terms, you and Somewhere Inn are each waiving the right to a trial by jury or to participate in a class action, collective action, private attorney general action, or other representative proceeding of any kind.

No Class Actions. YOU AND Somewhere Inn AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Somewhere Inn agree otherwise in a signed writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

Enforceability. If any provision of these Messaging Terms is found to be unenforceable, the applicable provision shall be deemed stricken and the remainder of these Messaging Terms shall remain in full force and effect.

Changes to the Messaging Terms

We reserve the right to change these Messaging Terms or cancel the messaging program at any time. By using and accepting messages from Somewhere Inn after we make changes to the Messaging Terms, you are accepting the Messaging Terms with those changes. Please check these Messaging Terms regularly.

Entire Agreement/Severability

These Messaging Terms, together with any amendments and any additional agreements you may enter into with us in connection herewith, will constitute the entire agreement between you and Somewhere Inn concerning the Messaging Program.
